LIN Ming Khin Charles

Charles is a Partner in our Litigation and Dispute Resolution Practice.  He is a Notary Public and a Commissioner for Oaths.

Charles specialises in medical law, construction law and commercial law including arbitration. He is a member of the Law Society of Singapore's advisory panel for medical law reform and is one of Singapore's leading lawyers for the Medical Protection Society Ltd, having advised and defended doctors for over 16 years.

He has defended numerous doctors in Court and before the Singapore Medical Council in proceedings concerning a wide range of subject matters including molest, fraud, criminal assault, prescription of Subutex and Benzodiazepines, aesthetic practices, Coroner's Inquiries for CVC lines, Steven Johnson's Syndrome, overdose of medication, biopsies, resections, negligent surgical procedures from simple excision of lipomas to heart surgery, ERCPs, otolaryngology, urology/stents, TURPs/TUIPs, ectopic pregnancies, termination of pregnancies, radiology, anaesthelogy, oncology, polypectomy, lobectomy, vaser liposuction, orbital lymphomas, nosocomical infections, epidurals, renal artery stenosis, renal cell cancer, renal vein thrombosis, serositis, laparoscopic cholecystectomy, necrotizing fasciitis, complicated cardiology cases including cardiothoracic surgery, amongst others.

Charles has also conducted other high profile cases successfully, including:

• The Marina Square construction arbitration;
• Man B&W Diesel S.E. Asia Pte Ltd and Another v PT Bumi International Tankers and Another [2004] 3SLR 267 (a claim for alleged defective marine propulsion engines resulting in landmark Court of Appeal decisions concerning offers to settle and the application of the Law of Tort in contractual claims);
• Smart Modular Technologies Sdn Bhd and Another v Federal Express (Singapore) Pte Ltd [2004] 3SLR 473 (where US$800,000 worth of computer chips were hijacked in transit and where provisions under the Warsaw Convention and the legal effect of airway bills were extensively litigated and argued successfully before the Court of Appeal);
• Public Prosecutor v Angliss Singapore Pte Ltd [2006] 4 SLR 653 (where the use of the “Halal” logo under the Administration of Muslim Law Act was litigated with public policy considerations extensively and contentiously argued).

He has substantial experience in employment law as well. He successfully advised a major international airline on issues of a collective agreement with the National Trade Union Congress in one of Singapore’s rare cases before the Commissioner of Labour.

Charles obtained his Bacherlor of Laws (Hons.) degree from the University of Buckingham U.K. and was admitted to the English Bar in 1989.  He is a member of the Honourable Society of Middle Temple.  After serving pupillage with Donaldson & Burkinshaw, he was admitted as an Advocate & Solicitor of the Supreme Court of Singapore in 1989.
